EB-2 Visa Professionals Holding Advanced Degrees or Those with Exceptional Ability, Permanent Residency (Green Card)
This is second preference immigrant category of visa for;
- Members of professions (including physicians) with degrees above a baccalaureate degree (those not so "extraordinary" as to qualify for a EB-1 visa),
- Members with baccalaureate degree and 5 years' experience in their possession (including healthcare workers i.e. nurses, therapists, speech-language pathologists, technologists and physical assistants),
- Aliens with "exceptional ability" in the sciences, arts or business, significantly above that normally encountered in their field,
- Entrepreneurs in the above sub categories working under the supervision of the employer.
It requires Labor Certification and a written job offer. Also, those in the medical field will most likely need additional special certification.
Submission Process
The petition process involves filing a USCIS Form I-140, all accompanying documentation and paying all required filing fees and when later approved, file USCIS Form I-485, all of its required documentation and paying all required filing fees. Spouse and unmarried children under 21 can accompany or follow to join by consular processing. They can work and attend school at the appropriate times.
